Terms of Service

These Terms of Service ("Terms") govern your use of the Groovv mobile application ("App") operated by Groovv ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Account Registration

  • You must be at least 13 years old to create an account
  • You are responsible for maintaining the security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must provide accurate information when creating your account
  • One account per person; accounts are non-transferable

2. Use of the App

2.1 Permitted Use

You may use the App to:

  • Catalogue and manage your personal vinyl record collection
  • Search and browse record information
  • Use the AI scan feature to identify albums
  • Track wantlist items and collection details
  • Subscribe to premium features

2.2 Prohibited Use

You may not:

  • Use the App for any unlawful purpose
  • Attempt to access other users' data
  • Reverse engineer, decompile, or disassemble the App
  • Use automated systems (bots, scrapers) to access the App
  • Resell, redistribute, or sublicense access to the App
  • Interfere with or disrupt the App's infrastructure
  • Upload malicious content or attempt to compromise security

3. Subscriptions and Payments

3.1 Free Tier

The App offers a free tier with limited features:

  • Up to 50 records in your collection
  • Up to 10 wantlist items
  • Up to 3 AI cover scans
  • Up to 50 Discogs imports
  • Basic dashboard

3.2 Groovv Pro

Groovv Pro is available as a subscription:

Monthly: $3.99 AUD per month

Annual: $39.99 AUD per year

3.3 Payment Terms

  • All payments are processed through the Apple App Store
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your Apple ID account settings
  • No refunds for partial subscription periods (refunds are handled by Apple per their policies)

3.4 Price Changes

We may change subscription prices. Any price change will take effect at the start of your next billing period, and you will be notified in advance.

3.5 Downgrading

If your Pro subscription expires:

  • Your data is not deleted
  • You retain read access to all your records
  • Adding new records beyond the free limit will be restricted
  • Pro features (charts, export, tags) will be locked

4. Content and Data

4.1 Your Content

  • You retain ownership of any content you create (notes, tags, custom data)
  • By using the App, you grant us a limited licence to store and process your content solely to provide the service
  • You are responsible for the accuracy of information you enter

4.2 Third-Party Content

  • Record metadata (titles, artists, labels, images) is sourced from Discogs and other databases
  • Album artwork is displayed under fair use for the purpose of identifying records in your personal collection
  • We do not claim ownership of third-party content
  • Third-party content is subject to the respective owners' terms

4.3 Data Export

Pro subscribers can export their collection data in CSV format. We believe your data is yours.

5. AI Features

  • The AI cover scan feature uses third-party AI services (OpenAI) to identify albums
  • Scan results are provided on a best-effort basis and may not always be accurate
  • Images submitted for scanning are processed in real-time and not stored
  • AI scan usage may be limited based on your subscription tier

6. Intellectual Property

  • The Groovv name, logo, and app design are our intellectual property
  • The App's source code, design, and original content are protected by copyright
  • You may not use our trademarks without prior written permission

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Record metadata or value estimates will be accurate
  • AI scan results will be correct
  • The App will meet your specific requirements

Collection value estimates are for informational purposes only and should not be relied upon for insurance, sale, or financial decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

  • You may delete your account at any time through the App
  • We may suspend or terminate your account if you violate these Terms
  • Upon termination, your data will be deleted in accordance with our Privacy Policy

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or via email. Continued use of the App after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria, Australia.
